Products Liability
Tafoya and Garcia has substantial trial experience involving highly technical product liability issues and the ability to make those issues accessible to juries. Tafoya and Garcia has defended personal injury and wrongful death cases arising out of consumer and occupation settings; claims of economic loss, diminished property value and damage to property; and cases arising out of serious accidents related to equipment or products. Tafoya and Garcia works with clients across the country in all aspects of employment litigation, including trials in cases arising under Title VII of the Civil Rights Act of 1964, the Civil Rights Act of 1991, the Equal Pay Act, the Age Discrimination in Employment Act, the Americans with Disabilities Act of 1990, the Family and Medical Leave Act of 1993, the Fair Labor Standards Act, the WARN Act and other federal and state laws regulating the workplace.
Tafoya and Garcia represents numerous clients before governmental agencies, including the Equal Employment Opportunity Commission, the Office of Federal Contract Compliance Programs, and the California Department of Fair Employment and Housing. We frequently represent clients during pre-litigation investigations and any litigation involving discrimination and harassment claims.
Wage and Hour MattersThe Fair Labor Standards Act and state law often imposes multi-level obligations on the employer, and violations of such laws can result in substantial liability. These disputes typically involve evidence related to hours worked and the nature of an employee’s job duties. Tafoya and Garcia possess unparalleled experience and have a track record of succesful litigation results. Tafoya and Garcia lawyers have interviewed literally thousands of employees to collect evidence for the resolution of and defense of many wage and hour disputes.
We can provide advice on avoiding wage and hour class actions at any stage in this process. We work closely with clients preparing policies on overtime and salary pay, determining which activities constitute compensable services under the law, and reviewing job duties to determine which employees qualify for overtime under federal and state law. We often represent clients during investigations by state and federal agencies.
Advising Management
A large part of our practice is devoted to consulting with employers on both unique and reoccurring personnel issues, such as hiring practices, retirement and downsizing events, how and when to take disciplinary action, how to draft and use employee handbooks, workplace safety issues, employment contracts, unemployment insurance issues, and training and educational programs for management and supervision, in English or Spanish.
